Duties of the Justice of the Peace

Justice of the Peace courts have original jurisdiction in Class C offenses in their designated precinct. These courts also have jurisdiction of minor civil matters. A Justice of the Peace may issue search or arrest warrants, and may serve as the coroner in counties where there is no provision for a medical examiner. The Justices are elected to a four year term of office by voters residing in their designated precinct. Additionally, Justices of the Peace are required by law to complete an 80-hour course covering the proper execution of their duties as a first term Judge. After that, they must complete twenty hours of relevant coursework per year.

The following is a short list of the functions that a JP courts conduct:

1.    Determines probable cause, issues arrest warrants, issues both adult and juvenile statutory warnings, and conducts bail examinations for arrested persons.
2.    Conducts reviews for sufficiency and issuance of search warrants.
3.    Conducts magistrations (Miranda Rights) for both adults and juveniles.
4.    Issues emergency protective orders.
5.    Conducts death investigations, and orders autopsies.
6.    Performs marriages ceremonies.
7.    Handles and collects fees, fines, and court cost.
8.    Prepares correspondence to defendant and parties to litigation as required by law.

CDL holders do not qualify for driver’s safety course or deferred, also speeding offenses of 25mph or more over the limit or going 95mph also do not qualify.

For all offenses of speeding in a school zone please add $25.00 more to the fine.

Deferred Adjudication- defendant is placed on a 90 day probationary period at the end of the probationary period the defendant must turn in a copy of their driving record to the court.  Driving records can be obtained on the Texas Department of Public Safety website.

Defensive Driving- defendants who take a driver’s safety course are responsible for enrolling in a driver’s safety course, and any fees associated with it. Defendants have 90 days to complete the course, and submit a certificate of completion to the court.
